If you are a UK-based employer (a company or an organisation) and looking to employ a non-UK person who is not a settled worker in the UK (for example, a British citizen or an Irish citizen) and does not otherwise hold immigration permission to work for you, you will be required to be formally authorised by the Home Office. This Home Office authorisation is known as a ‘sponsor licence’, and once you obtain one, you are known as a ‘sponsor’.

When you apply for a UK Sponsor Licence, the Home Office is not just looking at whether the application form is complete. You must present a convincing case that you are a genuine, lawful organisation capable of meeting all sponsor duties.

How should you present your sponsor licence?

Presenting your sponsor licence application to the Home Office an important exercise if you want to receive a sponsor licence from the Home Office. Your application should be persuasive, based on evidence, and focused on showing that you are a trustworthy sponsor. 

So, you need careful planning and execution.

  • how long you have been operating, meaning the length of time your business has been actively carrying out its activities, rather than simply the date it was incorporated or registered.
  • the industry/sector you are operating in, for example, construction, information technology, healthcare, hospitality, retail, engineering, financial services, or education
  • the products or services you provide to customers or clients, for example, clothing, furniture, food products, machinery, software, medical equipment, electronics, or automotive parts
  • the size of your workforce, and 
  • your business locations and areas of operation. 

Doing so helps you establish that your organisation is genuine and lawfully operating in the UK.

You can follow further steps as mentioned below.

1. Explain why you need a Sponsor Licence?

You must clearly explain the business reasons why you are applying for a sponsor licence. For example, you need to:

• recruit workers with specialist skills. 

• address labour shortages. 

• support business growth or expansion. 

• fill vacancies that have been difficult to recruit for domestically. 

Your explanation should satisfy the Home Office that you genuinely need sponsorship linked to your business activities.

2. Show that you are offering genuine roles

You should describe the roles you intend to sponsor, including job titles, their main duties and responsibilities, workers’ required skills and qualifications, and how the roles fit within your organisational structure. 

The Home Office must be satisfied that the vacancies you need to recruit foreign workers for are genuine and not created solely to facilitate immigration.

3. Demonstrate that you can comply with your sponsor duties

You should explain how your organisation will comply with its obligations, including how it will:

• Maintain accurate employee records. 

• Carry out right to work checks.

Monitor sponsored workers. 

• Report relevant changes in the organisation or employees through the SMS (Sponsor Management System). 

• Maintain documents as required by the Home Office. 

• Monitor sponsored workers’ visa expiry dates. 

If you are able to demonstrate that robust compliance systems are in place, it helps build confidence in your application.

4. Describe your HR systems

Your sponsor licence application should explain the processes you have in place to support sponsorship compliance, such as employee record management, attendance monitoring, recruitment processes, reporting procedures, and immigration compliance checks.

5. Furnish supporting documents

The documents you provide should be complete, up to date, and consistent with the information in your application. They should also be well organised and submitted in the format required by the Home Office. Missing documents, incomplete information, or inconsistencies between your application and supporting evidence may result in delays or even the refusal of your application.

6. Appoint key personnel

You must have appropriate individuals for the required sponsor roles, such as the:

• Authorising Officer. 

• Key Contact. 

• Level 1 User. 

These key individuals in your organisation should understand the organisation, be trustworthy, and be capable of fulfilling their sponsor responsibilities.

7. Demonstrate your compliance and transparency

Any unusual aspects of your business must be explained openly. For example, there is a recently established business, changes in ownership or directors, refusals of a previous Sponsor Licence, and any past compliance issues that have been resolved. 

Being transparent helps the Home Office assess your application fairly.

8. Prepare for a Home Office Pre-licence compliance visit

The Home Office may conduct a pre-licence compliance visit. You should be prepared and ensure that your HR records are accurate and accessible, key personnel understand sponsor duties, business operations reflect the information you have provided in the application, and systems for monitoring sponsored workers are operational.

9. Present a coherent business case

Overall, your sponsor licence application should demonstrate that your organisation is genuine and lawfully operating, explain the commercial need for a sponsor licence, show that the roles are legitimate and necessary, demonstrate effective HR and compliance systems, and present a well-organised, honest, and evidence-based application.
